Article 1. Party responsible for the data

Công ty Cổ phần Khải Vy (MerPerle Resorts & Hotels), Enterprise Registration Certificate No. 0302028516, determines the purposes and means of processing the personal data described in this policy. Contact details are in Article 10.

Article 2. Data we collect

When you send a request through a form on the website:

  • Full name and phone number (required).
  • Email, company or organisation name (optional; travel agencies should give their company name).
  • Details you fill in yourself: expected dates, number of guests, number of tables, number of rooms, type of event, message.
  • Accompanying information that shows where the request came from: the page you are viewing, the first page you visited, the page that referred you to the website (without query parameters), the advertising campaign code (UTM) and the ad click identifier, if any.

When you use the website:

  • Your cookie and language choices.
  • Your IP address, used temporarily to block automated form submissions. The website keeps it only in one-way encrypted form and deletes it after two days at most.
  • If you consent: traffic measurement and advertising data (browser identifier, IP address, device information) through the tools listed in the Cookie Policy.

The website does not collect payment information. Online booking takes place on the booking partner's system, under that partner's terms and policies. We do not ask for sensitive data; please do not include health, religious or financial information in your message.

Article 3. Purposes of use

  • To advise, quote and respond to your request; to contact you again by phone, email or the channel you choose.
  • To pass your request to the Sales department of the relevant property and track it in our customer management system.
  • To send an email confirming that we have received your request, if you enter an email address.
  • To block spam and misuse of the form.
  • If you consent: to measure visits and advertising performance.

We do not use form data to send advertising by SMS, email or Zalo without your separate consent.

Article 4. Consent

  • By pressing send on the form, you agree to our processing the form data for the purposes in Article 3.
  • Analytics and marketing cookies are used only when you choose to accept them on the cookie banner. By default, these cookies are off.
  • You can change your cookie choice at any time using the "Cookie settings" button at the bottom of every page, and you can withdraw your consent under Article 8. Withdrawal does not affect processing carried out before it.

Article 5. Recipients and storage location of the data

  • The Sales department of MerPerle Dalat Hotel or MerPerle Nui Sam Resort and authorised managers.
  • The website server is located in Vietnam. The website does not keep the content of requests; the content is passed immediately to internal email and the customer management system.
  • The company's email system, and the email delivery service Resend (servers in the United States), to send notifications to the Sales department and confirmation emails to you.
  • The customer management system Pancake CRM, a provider in Vietnam.
  • If you accept cookies: Google (Analytics), Meta (Facebook, Instagram) and TikTok receive measurement data and may process it outside Vietnam under their own policies. For the request submission event, the website sends Meta your IP address, browser information and Meta's cookie identifier; it does not send your name, phone number or email.
  • Competent state authorities, when required by law.

Data is transferred abroad only for the purposes stated above. We do not sell personal data.

Article 6. Retention period

  • The website does not keep the content of a request after passing it on.
  • Records in internal email and the customer management system: kept for as long as needed to handle the request and no longer than 24 months from the last contact, unless a transaction arises that the law requires us to keep for longer.
  • Cookies: according to the durations in the Cookie Policy.

Article 7. Data protection

  • Connections are encrypted (HTTPS); access keys for services are kept in the server's secret configuration; access rights are limited by job role.
  • If data is exposed or lost, we handle the incident and notify the competent authority and the people affected as required by law.

Article 8. Your rights

Under the law on personal data protection, you have the right to:

  • Be informed about the processing of your data; give, refuse or withdraw consent.
  • View, correct, request deletion of or restrict the processing of your data; request a copy of your data.
  • Object to the processing of your data for advertising purposes.
  • Complain, denounce or bring legal action as provided by law.

To exercise these rights, please send a request to huan.luu@merperle.vn, with the full name and phone number you used when sending the form. We will confirm receipt of your request within two working days and handle it within the time limit set by law.

Article 9. Changes to this policy

When this policy changes, we update this page and the update date at the top of the page. If the purposes of processing or the recipients of the data change, we will ask for your consent again where the law requires.
